As the elderly population increases in the United States, so does the number of patients living in long-term health facilities. As the number of patients in long-term health care facilities increases, so does the number of reported abuse and negligence cases. Today, there are thousands of lawsuits being filed because elderly patients are experiencing abuse and neglect at alarming rates. No one deserves to be abused or neglected; and if this occurring to your loved one, then you may have a malpractice lawsuit against the nursing home.

What is malpractice?

Malpractice is when a doctor, a nurse or other medical expert makes a mistake in a patient's care that results in injury or death. It does not matter if the mistake was unintentional or intentional. Malpractice is when the medical expert fails to provide the best care possible. Malpractice does occur in nursing home. Malpractice in a nursing home is when a patient is abused in any way or is neglected for any reason.

By state law, the nursing home has the responsibility to proper take care of all aspects of your loved one's life. They have the responsibility to see that they are receiving the proper medical care, personal treatment, and activities of daily living. If not, then they are performing malpractice because this bad treatment can lead to very serious medical problems, including death.

Being mistreated, abused or neglected in a nursing home is just like being mistreated, misdiagnosed, abused, or neglected by a doctor in a doctor's office or hospital. It is grounds for a lawsuit, especially if the mistreatment, abuse, or neglect leads to a more serious injury or death of the patient. The nursing home is responsible for the complete care of your loved one and they should not receive anything less than the best care possible.

Then you should consider contacting a nursing home lawyer to get information on a possible lawsuit.
