Before an employer can get a background report for employment purposes, he or she must notify the FCRA in writing. Even if the employer is simply conducting inquiries he or she needs to get consent from FCRA.
If an employer decides not to hire an individual because of any information contained in the report than the employer needs to file a pre-adverse action disclosure along with a copy of the consumer report with FCRA. The employers also need to inform the individual about the consumer report agency and provide the name and address of the consumer reporting agency.
Most background checks will include a verification of social security number. Many background checks include an analysis of the individual's work history, educational qualification and credit report. Some background checks include credit payment records, driving records or criminal history.
There is some information that cannot be disclosed in background checks under any circumstances. School records are confidential and cannot be released without the consent of the student. Some states also do not allow employers to run background checks into arrest and conviction records. Medical records cannot ever be disclosed in background checks and an individual cannot be discriminated against because of disability.
Individuals applying for jobs should be prepared for background checks. A good way to do this is to be aware of the information that an employer may find if he or she runs requests a background check. The best way to prepare for a background check is to be aware of the information that an employer might find. Get a copy of your credit report. If there is erroneous information, dispute it with the creditor. You should also check your motor vehicle record by requesting a copy of your record from your state Department of Motor Vehicles.
