:Law of services----Your seniority in the organization

Every person who has been appointed in an organization wants that he must be getting promotion in the organization so that his income must increase and also he must get a higher status in the organization which shall be making a place for him in the society around him.  The man who does not get promotion, means he is not a good person, he is not efficient, he cannot work, his work and conduct is not satisfactory, he has not increased his knowledge, he could not bring himself as per the wishes and desires of his employer or his seniors and that is the reason his name has not been recommended for promotion nor his name has ever been considered for promotion.  And if considered, he was not found fit for promotion..  Therefore, it is the duty of an employee to get knowledge of his seat, about his organization and must try to establish that he is efficient and he is a fit person to be given the next job in the cadre.

An employee must understand that his promotion shall be based on his seniority in the organization and therefore, he must ensure that he is having a seniority list in his hand.  He must know the law on the basis of which seniorities are maintained.  If he had been selected along-with others in a selection, then the merit prepared by the selecting agency shall be the seniority amongst the candidates in the same batch provided they join their jobs within a reasonable time and similarly if they have been taken from the lower cadre, they shall be placed in the same seniority order as they had been maintaining in the lower cadre/post.  If an employee is ignored while making promotions and gets promotion at a later date, then he shall be having his seniority from the date of such promotion. confirmation shall not change the seniority.  If two and more candidates are recruited on the same date, the man who is senior in age shall be senior to the man who is junior in age.  Here in India some jobs are meant for some categories and specific quotas are given to them and people getting quota posts prior to their seniors shall be getting their seniorities as per the date of their promotion. So we must be sure that our seniority is in order and if need be, we must represent against wrong seniority fixation.  We can file an appeal and then a review too and if still we are not satisfied, we can go a court of law and get justice.  We must see that our seniority is maintained rightly because most of the employers give further promotions on the basis of this seniority and names of senior people are considered first and they are ignored only when they are not found fit.
