Los Angeles, California is a booming city. Hundreds of thousands of people are migrating to L.A. to take advantage of its flourishing economy. These migrants also include businesses and corporations.

In the world of business, especially in a Californian setting, disputes involving two firms or entities cannot be avoided. Regardless whether one owns just a small deli, runs a petite boutique or is part of a huge enterprise.

It does not matter how well one handles his affairs or how pleasantly he/she deals with his/her clients or creditors. There will come a time when disagreement and a need for compromise between both parties come about. This is inevitable.

Businesspersons would not want this to happen. Failure to come to an agreement between partners or clients is fatal. This could mean loss of income, accumulated expenses or stoppage in their production. When these take place, they usually try to contact a business dispute lawyer for a legal consult.

With the help of their attorney, they would be able to come up with an easy, cheap and efficient solution to their problems.

This article aims to discuss the various methods being used by lawyers on how to solve business disputes without going to court. These methods are the following:

Negotiation - this is the least complex and cheapest of all methods. Simply put, it is the method where parties sit down and lay out the problems as well as the possible solutions. It is the least complex because only the parties decide on how to come up with solutions. There is no need for a judge or a mediator.

However, without an outsider's opinion on the problem, this usually requires the longest period to resolve.

Mediation - this method requires the parties to sit down and meet with a third party who guides them in achieving the proper solution to their dispute. The mediator only helps by weighing the strengths and weaknesses of both parties' arguments, and has no authority to decide for them.

With the help of the mediator, the parties may take either one's solution, they may meet halfway, or they may even think of a different answer to their queries. It is totally up to them. The topics taken up here is usually confidential. The discussions and materials are not admissible as evidence in court.

Since the decision-making is left to the will of the parties, they may scrap out the agreed solution and come up with another one, in case the old solution fails.

Arbitration - the arbitrator acts like a judge. In this method, parties submit to the arbitrator, a third party, their conflicting arguments and claims. After the hearing and after a careful study of the contentions of both sides, the judge makes the decision based on the law and usually chooses the solution given by the party who presented the strongest case.

Parties are bound to follow the decisions of an arbitrator. After the verdict has been laid down, the parties cannot anymore come up with another solution.

Litigation - when all other methods fail, the parties can submit their differences to the court. The judge carefully examines the facts of the case, the issues involved, as well as the contentions of both sides. From these, the judge, applying the necessary and applicable business laws shall give out his ruling. The verdict laid down by the tribunal, absence of an appeal, shall be final and executory.

In all four methods abovementioned, it never hurts to hire a Los Angeles Business Dispute Attorney to guide you every step of the way. With the help of your counsel, you can avoid unnecessary defaults and delays that may possibly cause you to lose your case.
