Why the Dealer won't help me
Its a common story. You purchase your dream car after years of saving to afford it. Then, something goes wrong, the engine stalls, the transmission slips or the windows leak. You take the vehicle in to the Dealer's Service Department and are met with a "Who Cares?" attitude. It seems that you are pushed from person to person, then, the dealer either cannot fix the problem or cannot even find it. It happens to people every day all across the country.
What you have to understand is that the Dealer's job is to sell vehicles, and that is the only way that they look at it. Sure they are obligated to attempt to repair the vehicle while it is under warranty, but their main focus is on making the sale. That is where their money is made, that is where the salesman makes his commission, that is where the owner makes his profit. If you have a defective vehicle that ultimately cannot be repaired, and you pursue a Lemon Law claim, you will be proceeding against the Manufacturer only, and not the vehicle Dealer. The Dealer, of course, knows this, and hence conducts itself accordingly. Part of the reason for their indifference is because they are not liable for defective vehicles. They know that the responsibility for the vehicle ultimately lies with the Manufacturer, so they merely do what it takes to give the appearance of giving help. Granted, every dealership does not act in this manner, but with the number of calls that I get regarding defective vehicles, I know that many dealers operate in this exact fashion. It is in this instance that you need to hire an experienced Lemon Law Attorney.
A lemon law attorney can guide you through your state's requirements and will ultimately seek to get you either a full refund of the purchase price or a free replacement vehicle. In most states, it is completely free to pursue a lemon law claim, because the lemon laws provide that the manufacturer of the vehicle must pay your attorney fees.
